What is the Administrative Review Tribunal (ART)?

The ART is an independent body that review certain immigration and citizenship decisions made by the Department of Home Affairs. It assesses whether the original decision was correct based on the evidence, facts, and law.

When Can You Apply for a Review?

You may seek a review for decisions such as: 

​

• Visa refusal or cancellation 

• Character-related visa refusal or cancellation 

• Australian citizenship refusal or cancellation 

• Nomination refusal 

• Sponsorship 

 

It is important to keep in mind that there are strict time limits for submitting your review application, so acting promptly is essential.

 

What Will Happen to My Application After a Review?  

 

When you apply for a review through the Administrative Review Tribunal (ART), the Tribunal will:

• Consider all evidence and information provided by you and the Department of Home Affairs 

• Determine whether the original decision was correct based on the facts and the law 

• Make a decision which may: 

• Affirm the original decision 

• Vary (alter) the original decision 

• Set aside the original decision and substitute a new decision 

• Remit (return) the matter to the decision-maker for reconsideration

If the Tribunal changes the decision in your favour, your visa or application may be granted, or the cancellation/revocation may be overturned. If the original decision is upheld, you may may still have options to appeal or seek judicial review, depending on your circumstances.

The fees listed above are the standard charges. In some cases, certain review applications may be exempt from fees or eligible for concessional rates depending on your circumstances. You may receive a 50% refund if the review outcome is in your favour.
